Jurors to resume deliberations in Tulsa police trial Monday

The trial for Officers Jeff Henderson, 38, and Bill Yelton, 50, began Aug. 1 in U.S. District Court in Tulsa.

A 12-person jury began deliberating Friday after 14 days of testimony and cross examination. After three hours of deliberation, the jury asked to be dismissed and to return Monday. U.S. District Judge Bruce Black of New Mexico sent the jury home at 5 p.m. Friday. During the trial, prosecutors called 40 witnesses, while defense attorneys called 13.

Henderson faces 53 counts alleging civil rights violations, drug conspiracy and other crimes, while Yelton faces eight counts alleging civil rights violations, suborning perjury and retaliation against a witness.

Attorneys for Yelton rested their case Monday after calling seven witnesses. Henderson's attorneys rested his case Thursday. Both Henderson and Yelton took the stand in their own defense. Their trial is the second since June involving Tulsa police officers. On June 10, two officers were acquitted and a former police officer was convicted of charges of drug conspiracy and theft of U.S. funds during an FBI sting in May 2009.


Key developments Judge Black threw out one count against Henderson, which alleged that he attempted to bribe government witness Brandon McFadden. Black said the government failed to present sufficient evidence to support that claim.

Prosecutors produced cell tower records that appeared to show that Henderson was not at a surveillance location where he previously had testified he was.

Interesting moment Officer Frank Khalil's testimony on Tuesday drew a line in the sand for jurors who have heard testimony from many witnesses in the prosecution's case, which alleges that 32 people are victims. "Everybody's lying," Khalil told the court.

Key testimony Henderson denied stealing drugs or money from crime scenes, asking informants to sell drugs, coaching informants on testimony and lying under oath.
